      On 30 December 2007, following announcement of the presidential election results, violence broke out in several places across Kenya amid claims that the Electoral Commission of Kenya (ECK) had rigged the presidential election. Sporadic eruptions continued for many weeks, bringing death and destruction to thousands of Kenyans.

      An African Unionsponsored Panel of Eminent African Personalities led by former United Nations Secretary General Kofi Annan brokered a settlement which heralded a government of national unity between the main political parties and a common commitment to urgent constitutional reform. The settlement included the appointment of two commissions, one to examine the violence and the other, the Independent Review Commission (IREC), to examine the December 2007 Kenyan elections from various perspectives.

      Joseph Otieno who is the District Commissioner of Marakwet, Witness No. 72, Francis
      Mutie, District Commissioner, Trans Nzoia East and Commission Witness No. 73, Seif
      Idd Matata, District Commissioner Trans Nzoia West. We had to hear them in private
      because of the experiences at the time and I would be making an application that their statements be made public for purposes of this Commission.

      A combined opposition likely to dispute the results, leading to:

      • Resorting to leagl redress and possible attempts to form a parallel Governmet
      • Incitement of there supporters to violence especially in major towns such as Nairobi, Mombasa, Kisumu, Eldoret and Kakamega and otehr urban areas where criminal elements could capitalize on the shanky environment to perpetuate crime.
      • Spontaneous explosion/intesity of ethnic clashes mostly in traditional hotspot areas and heightened activities by criminal gangs like Mungiki, Taliban, Kamjesh, Chinkororo, SLDF and RRC.

      The witness is a 49 year old farmer and mother of 12 children of whom seven remain alive. She lives in kisumu. This study demonstrates the desparate personal situation that some victims have found themselves in as a result of the PEV. There also seems little followup or contact with the victim on the part of authorities. Identfying material has been removed from the original statement.

      Impunity

      Definition of Impunity

      Impunity Means “exemption from punishment or loss”.433 In the international law of human rights, it refers to the failure to bring perpetrators of human rights violation to justice and, as such, itself constitutes a denial of the victims’ right to justice and redress. Impunity is especially common in countries that lack a tradition of the rule of law, suffer from corruption or that have entrenched systems of patronage, or where the judiciary is weak or members of the security forces are protected by special jurisdiction or immunities. The amended Set of
      Principles for the Protection and Promotion of Human Rights Through Action to combat Impunity, submitted to the United Nations Commission on Human Rights on 8 February 2005, defines impunity as:

      " the impossibility, de jure or de facto, of bringing the perpetrators of violations to account – whether in criminal, civil, administrative or disciplinary proceedings – since they are not subject to any inquiry that might lead to their being accused, arrested, tried and, if found
      guilty, sentenced to appropriate penalties, and to making reparations to there victims"

      The North Rift region comprises the districts of Uasin Gishu, Trans Nzoia West, Trans Nzoia East, Nandi North, Nandi South, Marakwet, Keiyo, Baringo North and Baringo South.       Violence in Western and Nyanza Provinces

      Western Province

      Introduction

      Western Province borders Uganda to the West, Nyanza Province to the South and
      Rift Valley to the East. The province is home to the Luhya ethnic group who are
      divided into various subgroups. Though the rural parts are largely
      homogeneous, there are parts of the province which have settlement schemes
      inhabited by people from diverse ethnic origins. The urban centres are also ethnically mixed.

      Introduction

      The City of Nairobi has through the years provided the barometer for Kenya’s
      volatile politics from colonial times to the present. It began as a temporary camp
      at the turn of the twentieth century upon a chance decision by George Whitehouse the engineer in charge of construction of the Uganda Railway who chose this location as the springboard for embarking on the challenging phase of laying the railway tracks across the Rift Valley. This temporary campthe most unlikely of locations by default became Kenya’s capital city and a commercial hub for the East and Horn of Africa region.

      Introduction

      The point of discussing the plight of Internally Displaced Persons (IDPs) here is to make recommendations to promote and enhance their future protection. IDPs have been defined as, “persons or groups of persons who have been forced or obliged to flee or leave their homes or places of habitual residence, in particular as a result of or in order to avoid the effects of armed conflict, situations of generalised violence, violation of human rights or natural or humanmade disaster, and who have not crossed an internationally recognised state border245”

      Before, during, and after the elections, politicians, government, NGOs, members of the media itself, and parts of the public, all had views about whether and how the spread of information through the print and broadcast media had contributed to the 2007 post election violence. The Commission asked a number of individuals to testify before it concerning the role of the media in the post election its violence.

      Deaths and Injuries

      Loss of life through conflict is a measure of the scale of conflict hence the need to
      ascertain the number and causes of death. Further, it is a recognition that conflict is basically about human life and all else is secondary. The Commission also understood its terms of reference as requiring it to “establish the facts and circumstances surrounding the post election violence”. This means that we had to establish the number of persons who died and those who were injured as a result of the post election violence.

      The findings we make in this Chapter are derived from the facts collated and analysed from oral and documentary evidence submitted before the Commission. There are 4773 pages of recorded sworn testimony from 156 witnesses and 144 other witnesses who submitted depositions and recorded statements. There are nine volumes of exhibits running into more than 3500 pages and we had at our disposal, in terms of our terms of reference, official reports of previous investigations, investigations from other institutions or organizations and research material from our own researchers and investigators.

      The Commission was given a special role in relation to the State Security
      Agencies (SSAs) and their involvement in the Post Election Violence. Articulated
      clearly in the Terms of Reference (ToRs) it was mandated to “investigate the actions or omissions of State security agencies during the course of the violence, and make recommendations as necessary.” A broad interpretation of this task was applied to include the actions of these agencies in the lead up to polling day was a necessary step to take in determining the level of preparation and planning undertaken. Also individual members, officers and employees of these agencies were considered to be within the scope of the investigation.

      To ensure that the National Dialogue and Reconciliation is carried out in a
      continuous and sustained manner towards resolving the political crisis arising from

      Nairobi, 21 February 2008Jean Ping, the Chairpersonelect of the African
      Union Commission, this afternoon paid a courtesy call on Kofi Annan, Chair
      of the Kenya National Dialogue and Reconciliation, and Benjamin Mkapa,
      former President of Tanzania.


      Both Annan and Mkapa, along with former South African First Lady Graça
      Machel, are members of the Panel of Eminent African Personalities asked by
      the African Union to assist Kenya in resolving its postelection crisis.
      Mr. Ping came to extend his moral support to the Panel. He discussed with
      Annan and Mkapa the recent progress made in the Dialogue and explored
      further possible support that the African Union can offer to the Panel.

      Unfortunately, it appears that one of the parties may have misunderstood remarks made during the Question and Answer period in reference to the possible "grand coalition" which could oversee reforms within 2 years, followed by Presidential elections. This was discussed this morning with the parties and was clarified.


      The Chairman's statement that a "grand coalition" is a possibility to manage the
      reform process within a twoyear period represents his perspective on the
      discussions, and does not imply a formal agreement between the two parties.
      The parties continue to work constructively and are making good progress.

      In December 2002, Kenyans decisively rejected despotism and kleptocracy. In one of the most
      peaceful regime changes in Africa, Kenyans voted out the Kenya African National Union, the party
      that has ruled the country since independence from the British in 1963. Although at first tolerant,
      the Kenyatta regime became increasingly corrupt and authoritarian. By the time he passed away
      in 1978, President Kenyatta had crafted a state symbolized by personal rule, a culture of nepotism,
      public theft, and gross violations of human rights. Incredibly, President Daniel arap Moi,
      heightened repression and perfected the corrupted state left behind by President Kenyatta. The
      MoiKANU regime was marked by shameless graft, abominable human rights violations, impunity,
      and national decay. This is the legacy that Kenyans hope President Mwai Kibaki and the ruling
      National Rainbow Coalition will transform.

      Given the disputed elections and the divisions in the parliament and the country, neither side is able to govern without the other. There needs to be real power sharing to move the country forward.

      A coalition must be a partnership with commitments on both sides to govern together and push through a reform agenda for the benefit of all Kenyans.

      In February 2003, hardly a month after being sworn in, Kenya ’s President Mwai Kibaki appointed a
      Commission of Inquiry into one of the largest financial scandals in Kenya ’s history. The fiddle,

      ‘Goldenberg’, is estimated to have cost Kenya some US $600 million in just less than three years.

      At the end of December 2007, widespread violence broke out in Kenya following the announcement
      of the results of presidential elections held on 27 December. In the ensuing days, official figures stated
      that over 1200 people were killed, there was massive destruction of property in some areas, and
      several hundred thousand Kenyans were displaced from their communities. In addition, human rights
      defenders who made Statements critical of the electoral process began receiving serious death threats.
      In light of this situation, the Office of the High Commissioner for Human Rights deployed a factfinding
      mission to Kenya from 628 February 2008.

      attacks, targeting mostly Kikuyu and Kisii people in and around the town of Eldoret,
      could continue unless the government and opposition act to stop the violence, Human
      Rights Watch said.

      into hiding after receiving anonymous death threats.

      The first call at 8.05pm came from an unidientified woman who warned Ilado that

      The Law Society of Kenya condemns in the strongest
      terms the unfortunate incident of electoral violence
      which continues to rock various parts of the country
      following the announcement by the ECK of the
      elections results. The Law Society of Kenya expresses
      concern over the brutal killings and the rising number
      of displaced victims. Businesses have been set ablaze,
      property destroyed and brutal killings witnessed.
      Thousands of Kenyans have become internally
      displaced persons –refugees in their own country.
      Dozens of women, men, boys and girls have been
      raped during the mayhem.

      Conclusions on Kenya
      1. The Council remains extremely concerned at the continued uncertainty, instability and serious crisis
      arising from the recent presidential elections in Kenya and is monitoring the situation closely. The Council
      regrets the loss of life and the serious humanitarian consequences that have ensued after the elections. It
      condemns the acts of violence that have taken place, for which there can be no impunity, and underlines
      the need to protect the human rights of all in Kenya. It calls upon all the political leaders in Kenya to act
      urgently to bring vilolence to an end and ensure security for all Kenyans by publicly and unequivocally
      rejecting all forms of violence, restraining their followers and encouraging all concerned, including police
      and army officials, to exercise maximun restraint. It calls on all political leaders to resort to dialogue
      immediately and secure a political solution based on democratic principles and to the benefit of the
      Kenyan people. The Council further calls upon the Kenyan authorities to restore the right of the media to
      work freely and the right of assembly and to avoid excessive or lethal force against those demonstrating
      peacefully.

      We the Spiritual Leaders of Korogocho feel impelled to advocate for the rights of the common
      mwananchi against all kinds of exploitation and manipulation. The recent skirmishes occasioned by
      the just ended general election have prompted in us the following concerns which we feel need
      urgent addressed.
      1 INSECURITY
      The community has witnessed unacceptable mass killing of the poor, destruction of property,
      people forced to leave their homes and become refugees elsewhere just because they belong to a
      particular ethnic group or have a particular political stand. This situation of insecurity has subjected
      the entire community to a life of constant fear. We condemn this situation in the strongest term
      possible and appeal for an immediate security reinforcement in the slum.

      About fifty religious leaders drawn from Christian and muslim communities in
      Korogocho will on 9th January Wednesday 2008 at 3.00 pm hold a Peace and
      Reconciliation Prayer at the playground of Ngunyumu Primary School Korogocho.
      Korogocho has been one of the worst hit slums in Nairobi over the violence, which has
      rocked different parts of the country since the General Election results were announced
      by the Electoral Commission. Like in other parts of the country, the violence has taken a
      tribal perspective in Korogocho. About eighteen people from the slum have lost their
      lives and property of unknown value destroyed. Hundreds of other residents have been
      displaced.
