WHO ARE WE?

MOPA (MOVEMENT FOR POLITICAL ACCOUNTABILITY) is a non-partisan coalition of organizations which brings together the independent sector, religious leaders, civil society organizations and other stakeholders to promote accountability of elected leaders

 

WHY?

MOPA seeks to infuse accountability on the political class from the “bottom-up”. This is because lack of accountability affects the socio-economic development of the country and leads to a culture of impunity and entitlement without focus on the needs of the majority of Kenyans

 

 

WHAT IS IT ABOUT? 

MOPA is an open citizens’ campaign on political accountability where Kenyans can demand and obtain leaders who can be trusted to keep the promises they make

PRESIDENTIAL ACCOUNTABILITY & HUMAN RIGHTS CHARTER WITH KENYANS

 

RECOGNIZING the right of Kenyans to enjoy human rights and hold their leaders accountable:

I ……………………………………. HAVING OFFERED MYSELF FOR ELECTION AS PRESIDENT OF THE REPUBLIC OF KENYA, PROMISE TO DEDICATE ALL MY ENERGY TO THE SERVICE OF THE PEOPLE OF KENYA PUTTING THE PUBLIC NATIONAL GOOD ABOVE ANY PERSONAL OR PARTISAN INTERESTS.

I UNDERTAKE TO INITIATE COMPREHENSIVE PRO-PEOPLE CONSTITUTIONAL REFORMS BUILDING STRONG INSTITUTIONS WHILE REDUCING THE POWERS OF THE PRESIDENCY

 

FURTHER, I PROMISE TO ALL KENYANS:

 

A: EQUITABLE SALARIES IN PUBLIC SERVICE

  1. I commit to the establishment of an autonomous public service salaries review board to independently revise and ensure that all public service salaries are equitable and in tune with those of other countries with similar social economic and human development indexes.
  2. I shall reduce total emoluments due to the President not to exceed a maximum of Kshs 1 million on which full payment of taxes will be made. Reduction will be effected pro-rata within the first year in office from Cabinet, Parliament, Permanent Secretaries, constitutional office holders and other senior positions in the public service. Pending reduction, I will put the sum in excess of 1 million to be equitably apportioned to the CDF of the 10 poorest constituencies in the country

 

B:  PUBLIC RESOURCES

  1. My Government shall allocate at least 2.5% of Kenya’s GDP (estimated at Kshs 1,600 Billion) to underdeveloped and marginalized areas especially the former northern frontier district in order to incorporate these areas as integral parts of Kenya.
  2. I shall ensure adherence to fiscal discipline in the utilization of tax revenues to guard against wastage, ostentatious spending and official extravagance including items such as limousines, furniture, carpets, overseas travel, per diems and personal allowances for senior government officials
  3. My Government shall improve the quality of the existing free primary education and shall within 3 years of election effect free and compulsory secondary education to every Kenyan completing primary school in fulfillment of the right to a proper education
  4. My Government shall have all loans incurred by the State first approved by Parliament and shall make all public debt public, transparent and open to scrutiny.

 

C: SECURITY

  1. In recognition of the legal duty of the Government to protect all its citizens, I commit to an independent Police Service accountable to a civilian oversight board. My Government shall significantly increase the number of police officers to the recommended UN ratio of 1 police officer for every 450 citizens, improve their training and welfare and ensure that law and order is maintained. I shall also ensure that police recruitment reflects merit, gender equity, national representation and that the entire police office is manned by competent officers who have satisfactorily completed at least secondary school education.

 

 D:  DILIGENCE IN PARLIAMENT

  1. I shall personally attend Parliament at least once every Parliamentary session and also during crucial debates where I will participate in proceedings fully cognizant of the collective responsibility of the Cabinet to the people of Kenya and the responsibility of Ministers and their Assistants not to mislead Parliament or the public.

 

E: TRANSPARENCY AND ACCOUNTABILITY

  1. I shall not appoint to cabinet or to public service men and women who have been incontrovertibly indicted in Government Inquiry Reports, Parliament’s watchdog Committees and other accountability institutions; who have been found to have unjustly enriched themselves from public funds; who have been involved in corruption and economic crimes; and / or who have perpetrated serious human rights violations in the past. 
  2. I shall ensure that my cabinet will reflect gender equity, be credible, representative of Kenya’s ethnic diversity, efficient and shall not exceed 20 Ministers for the effective delivery of service to Kenyans. I will restrict the number of Assistant Ministers to a maximum of 30.
  3. I shall ensure that the entire public service reflects gender equity, merit, ability, diversity, age structure and balance of Kenya’s national composition and gender parity. No retirees will be appointed to public service in order to give a chance to other able Kenyans to participate in their Government as fundamentally guaranteed by the Universal Declaration of Human Rights.
  4. Even though the law is silent on parliamentary scrutiny in public appointments, I shall have all members of my cabinet, Permanent Secretaries, chief executives of state corporations, the Commissioner of Police and heads of other public institutions first vetted and approved by Parliament.
  5. I shall be a champion of transparency, making my declaration of wealth and that of my family public and freely available for scrutiny. This will be a standard requirement for all public officials especially Ministers and Senior Government Officers.
  6. I shall require Ministers, Permanent Secretaries, Assistant Ministers, constitutional office holders and all public officers to obey the rule of law and heed summons issued by Parliamentary committees, Courts and other public bodies with powers to issue orders.
  7.  I shall direct the Attorney General to present to Parliament a bill to enact a Freedom of Information Law and repeal of the Official Secrets Act (Cap 187 Laws of Kenya).
  8. I shall visit every province of the country at least once every year and take at least one day in each to listen to the people so as to ensure that Kenyans participate in public processes. In addition, I shall hold a monthly Press Conference where members of the Press will be free to ask me questions.
  9. I shall require my Cabinet to hold an annual Ministerial “Public Accountability Forum” where all sectors of society will be invited with the aim of improving services.
  10. I shall protect multi party democracy and the rule of law by remaining faithful to the Political Party on whose ticket I am elected unless I have resigned from the party as required by law. I shall not appoint to Cabinet MPs from opposition parties without consulting and obtaining the consent of their sponsoring parties as required by law.

 

F: INTERNATIONAL TREATIES

  1. I shall direct the Attorney General to bring to Parliament a bill that domesticates locally all international human rights treaties and conventions which Kenya has signed and ratified.
